Brian Hickerson, Hayden Panettiereβs on-again-off-again boyfriend, was recently involved in an altercation at a bar in South Carolina, police say.
The Greenville Police Department identified Brian Hickerson and his brother Zachary Hickerson as two individuals involved in the incident at Wild Wing Cafe on Sept. 12, law enforcement told NBC News in a statement.
Zachary Hickerson, who was βhighly intoxicated,β was taken into custody and charged with disorderly conduct while Brian Hickerson was released from the scene, police said.
The incident comes just weeks after a police report showed that the brothers were present when Panettiere was pronounced dead on Aug. 18.
Zachary Hickerson and Brian Hickerson did not immediately respond to NBC Newsβ requests for comment.
According to Greenville Police, officers were dispatched to the restaurant at around 9:10 p.m. on Saturday in response to a reported assault. The officers detained multiple patrons as the situation was being investigated before determining that Zachary Hickerson had been heavily inebriated.
βHe began yelling profanities in a public setting, and as a result, he was taken into custody for disorderly conduct and transported to the Greenville County Detention Center,β police said in a statement.
Brian Hickerson was not charged.
In August, EMS personnel responded to a 911 call to Panettiere unresponsive at an apartment, where the brothers also were, according to a heavily redacted police report. Panettiere was in cardiac arrest when emergency personnel arrived. A cause of death has not been released.
Zach Hickerson was βvery emotionalβ during the resuscitative efforts on Panettiere, Greenville Officer Matthew Bryan wrote in the report. Brian Hickerson βdid not become emotional until EMS declared her officially deceased,β Bryan wrote.
